The District Clerk's Criminal Division is located on the 2nd Floor of the Nueces County Courthouse. This section of the office handles all aspects of the criminal filings including the filing of indictments, judgments, and issuing of warrants.

Getting Started:

Go to the Texas E-file website

If you already have an account for Civil E-filing you can use that log in for Criminal E-filing
If you don't have an account click the Register Now link

Your user name in E-filing is your email address.
Your password will be in the activation email that you receive.

Important Information When Registering:

If you have already registered with another E-filing provider, the same login credentials can be used on eFile.TXCourts.gov
As an attorney: remove any leading zeros from the Attorney Number validation field

How do I Eserve the District Attorney's Office?

Can I Eserve Subpoenas to the District Attorney's Office?
No, they have to be personally served.
What case number format do I use to conduct a search?
When searching for a case in Nueces County, you will use the following case number format: CR160022224, 17fc1234B (no hyphen or comma). Note the case number shown is what should be on the documents being e-filed, no missing numbers or rearranging. If you are not able to find the case that you are using to e-file on the portal, please contact our office at (361)-888-0495 for help.
Can Pre-file cases be E-filed?
No you will not be able to file a pre-file case (no indictment or information and complaint) and a Civil Writ of Habeas Corpus must be e-filed for all pre-file cases.
How do I upload exhibits?
All exhibits should be combined as one PDF and can be uploaded as an attachment to a motion or as an additional lead document (filer choice). If your document is over the maximum 25mb and you are filing as a lead, then you can separate it by a cover letter stating “Continuation of Exhibits”.
Do I file a proposed order as a lead document or as an attachment?
The District Clerk’s Office has opted out of using the attachment feature. All proposed orders being submitted must be uploaded as an additional lead document.
What do I do if I forgot to attach a signature page or exhibit to my already accepted filing?
Once the clerk has accepted your e-filing we cannot able to alter or add to it. You will need to file an amended document.
What filing code do I use?
The filing codes that are visible to a filer are mandated by the State, and meant to be generic. If you do not see a specific option, you will choose the closest one. The reviewer will/can change it to be more specific, based on the title of your document.
How do I receive a signed order certified/noncertified?
You must fax a Customer Order Form for Criminal Copies (found on the District Clerk’s website) to (361) 888-0759 with the case number, the style of the case, and title of the documents, how you are to receive them and phone number to call you back with the total dollar amount for your request. Once we receive the payment for your request we will mail them to you, or you can come to our Criminal Dept. to pick up them up. The cost is $1.00 per page and $1.00 to certify. If you are an appointed attorney then you will not be charged for your copies.
Will I receive the original file date if my filing was returned for corrections?
You have 7 consecutive days to resubmit with the corrections, to obtain the original filing date. You must either copy your envelope, or in the filing comment state the previous envelope number, date and time.
How do I submit documents under seal?
Documents can be mailed or brought over the counter in a sealed envelope and with case number, style of the case and clearly marked “This Envelope Contains Confidential Documents and is Submitted Under Seal”

What credit cards are accepted?
All major credit cards are accepted.
What if my envelope was returned for corrections by mistake?
If the District Clerk’s office returns an envelope by mistake, we do not have the function to go back and accept it. You still can receive the original filing date by resubmitting and either copy the envelope or under the filing comments state the original envelope number. If you have any questions or concerns please call our office at (361) 888-0495.
Which documents get a file stamp?
The first page of a lead or attachment will receive a file stamp. If there is a document you do not want file stamped, then you must upload it behind a cover letter, request, etc. as one PDF.
How should I set up my account with e-filing for criminal cases?
If you are a retained defense attorney then you must set up a firm account. If you are a court appointed attorney, with a current appointment, then you set up a waiver account.
Can I submit a document that does not have a case number on it?
All lead documents must have the correct case number located on the top. If an exhibit, notice, email, etc. is being filed without a case number, then it must be an attachment to the corresponding lead document.
How do I request a subpoena, and how will they be returned once service is attempted/completed?
You must e-file a criminal subpoena request form found on our website. Once we accept your request, we will issue and send them out via your request. If you are going to use a private process server then your process server can e-file the return, or drop it off at our criminal department. If it is being served by constable/sheriff then we will retrieve the returns and enter them into our case management system.
Can I e-file a document with multiple case numbers?
No. Each document can only contain one case number.
How can I edit my envelope after I have already submitted it?
Under your Filings tab, you can find the cancel button on the right side of each envelope. This will allow you to start from scratch.
Can I e-file a document with names of multi-defendants?
No, each case can only have one defendant.
